Arbitration

Arbitration clauses, appointment of arbitrators, representation and enforcement of awards in domestic and international arbitration.

Arbitration is an alternative method of adjudication in which disputes are resolved by independent arbitrators chosen or accepted by the parties, instead of state courts. Frequently preferred in commercial disputes, it offers confidentiality, speed and flexibility.

Arbitration is an important tool particularly in international trade, construction, energy and investment disputes. It is less bureaucratic than court proceedings and allows the parties to set their own procedural rules. Arbitral awards are also recognised in most countries.

Boybey Law & Consultancy advises and represents clients in domestic and international arbitration. We provide legal support in drafting arbitration agreements, appointing arbitrators, building the defence strategy and enforcing arbitral awards, aiming to resolve commercial disputes efficiently and confidentially.

Frequently asked questions

How should an arbitration clause be drafted?

The arbitration agreement must be in writing, either as a clause in the contract or as a separate agreement. Clearly specifying the seat, applicable rules, number of arbitrators and language prevents procedural disputes later.

Can an arbitral award be appealed?

Arbitral awards cannot be appealed on the merits, but an action for annulment can be filed on the limited grounds set out in the law. In domestic arbitration, this action is filed at the regional court of appeal within one month of notification of the award.

Can a foreign arbitral award be enforced in Türkiye?

Foreign arbitral awards can be enforced in Türkiye once a recognition and enforcement decision is obtained under the New York Convention, to which Türkiye is a party, and the related legislation.
