What Are Employee Rights in Case of Unfair Dismissal?
1 min read İsmail Boybey
Employment contracts are sometimes terminated by the employer. However, not every termination is “justified”. In case of unfair dismissal, the employee has several rights.
Severance and notice pay
If the employee has worked at the same workplace for at least one year and was unfairly dismissed by the employer, they are entitled to severance pay. An employer who fails to observe the statutory notice period must also pay compensation in lieu of notice.
Overtime and annual leave pay
Many employees do not receive their overtime, annual leave or public holiday pay. These rights can be claimed through the labour court even after leaving the job.
Reinstatement claim
Employees working under an indefinite-term contract may file a reinstatement claim in case of unfair dismissal. The court examines the employer’s grounds for termination and may order the employee’s reinstatement or the payment of compensation.
In short, if you believe you have been unfairly dismissed, it is important to consult a lawyer without delay to protect your rights. Remember that strict time limits apply to these claims.
